INTRODUCTION

The present general conditions of sale determine the rights and the obligations (bonds) to « liberty-mode.fr » and of the buyer within the framework of the sale of the goods (properties) proposed by « liberty-mode.fr » on its Web site.

ACCEPTANCE OF THE CONDITION

The customer recognizes to have acquainted, at the time of the signing of command (order), terms of sale expressed on this screen, and expressly declares to accept them without reserve.

The present general conditions of sale govern the contractual relations between « liberty-mode.fr » and his (her) customer, both parts (parties) accepting them without reserve.

These general conditions of sale will prevail over quite other conditions appearing in quite other document, except preliminary, express and written dispensation.

PRODUCTS

Photos illustrating products do not enter the contractual field. If errors got there, on no account the responsibility of « liberty-mode.fr » can be engaged (started).
The majority of products proposed to his (her) customers by « liberty-mode.fr » are available.
« liberty-mode.fr » implements (operates) everything to honor all the commands (orders) within the limits of available stocks. In the case of an unavailable article, if the payment already intervened, the customer will be paid off by the sending of a check.

ORDER

The systems of automatic recording are considered as being worth proof of the nature, the contents and the date of the command (order). « liberty-mode.fr » confirms the acceptance of its command (order) to the customer at the e-mail address whom this one will have communicated with him (her).
The information expressed by the buyer during the grip (taking) of command (order) engages (starts) this one: in case of error in the wording of the address and phone number (coordinates) of the addressee, the salesman would not know how to be considered responsible for the impossibility in which he could be to deliver the product.
The sale will be concluded only as from the confirmation of payment of the command (order).
« liberty-mode.fr » reserves the right to cancel any command (order) of a customer with whom would exist a dispute concerning the payment of a previous command (order).

DELIVERY

The contractual period (delay) of expedition (shipping) is fixed to 5 working days as from the collection of the command (order).
« liberty-mode.fr » makes however a commitment to assure (insure) an expedition (shipping) the working day following the collection of the command (order).
Attention: if your parcel was manifestly damaged in the delivery, refuse him (it). Do not sign the delivery order, this will avoid you paying the expenses of return.
For the deliveries outside metropolitan France, the customer makes a commitment to settle (adjust) all the taxes due to the import of products, customs duties, value-added tax, and all other taxes were owed by virtue of the laws of the country of reception of the command (order).
« liberty-mode.fr » gets free of any legal responsibilities if the acquittal (payment) of taxes was not made by the customer.
All the commands (orders) crossed (spent) to « liberty-mode.fr » are intended for the personal custom (usage) of the customers.
The customers or the addressees refrain themselves from any partial or total resale of products. The delivery will be made by post by colissimo (France or international as the case may be).

Postal charges

Postal charges are free for France about is the amount of the command (order).
For the deliveries in the countries of the European Union, postal charges are expressed in TTC.
For the deliveries in the other countries where the U.E as well as for FRENCH OVERSEAS DEPARTMENTS AND TERRITORIES, the postal charges are expressed in HT.

RETRACTION / RETURNS

The customer has 7 days as from delivery date to exercise his right of retraction and engage(start) a procedure of return of articles according to the capacities(measures) of the code of the consumption, article L-121-20.
Products have to be in a state and conditioning (packaging) of origin, and turned (returned) in 7 days which follow the delivery. The freight costs of return are chargeable to the customer. «liberty-mode.fr " advises the sending colissimo recommended which avoids any dispute as for the reception of the parcel.
The returns must be clearly identified (N of command (order), name, first name and address) and sent in:

After reception of the goods and from the treatment of return, we shall send to the customer an email informing him (it) about the amount of its refund(repayment).

« liberty-mode.fr » reserves the right to refuse the refund(repayment) of return if articles made the object of a prolonged custom(usage), if they returned degraded, dirty, without their original packing, or in a state not allowing a putting on sale. The original of the invoice of sale must be joined (contacted) to turned (returned) articles, asks to the customer to keep (preserve) a copy. The refund (repayment) will be made by check.

PRICES

The prices are expressed in Euro.

The price indicated in the confirmation of command (order) is the definitive price. It is expressed inclusive of all taxes for metropolitan France and countries of the European Union, and exclusive of tax for French overseas departments and territories and other countries.

PAYMENT

The price charged to the customer is the price indicated on the confirmation of command (order) sent by «liberty-mode.fr ". Your payment is directly made at a bank in a secure environment. The command (order) validated by the customer will be considered actual only when the centres of banking payment concerned will have given their agreement. In case of refusal of the said centre, the command (order) will automatically be cancelled and the customer prevented (warned) by mail.

LITIGATION

The present contract is subjected to the French law.

« liberty-mode.fr » cannot be considered as person in charge of the damages of all kinds, so material as immaterial or physical, who could result from the misuse of the marketed products.
The responsibility of « liberty-mode.fr » will be limited, in any case, to the amount of the command(order) and would not know how to be questioned for simple errors or omissions which would have been able to remain in spite of all the precautions taken in the presentation(display) of products.
The complaints or the contestings will always be received with attentive benevolence, the good faith being always presumed at the one who makes the effort to expose(explain) his situations.
In case of dispute, the customer will address by priority the company to obtain an amicable solution. In defect, the Commercial court of Tours is only competent, whatever the place of delivery and the method of payment accepted.
